GENERAL TERMS AND CONDITIONS VILLA V


Definitions

Cancellation: the revocation or dissolution of the final reservation within the applicable time period or a no-show at the time of reservation.

Administrator means the person who, as the owner of Villa V, or on behalf of the owner of Villa V, manages Villa V.

Third party: any other legal entity that is not a guest, manager or owner.

Guest: a person who has reserved and is staying at Villa V and is registered as such.

Principal Guest: the person who has made a reservation at Villa V. The principal guest must be over 21 years of age and is responsible for his/her fellow guest(s).

No show: the non-use by the guest, without cancellation, of the reservation made.

Reservation: written confirmation by e-mail of the reservation request by Villa V.

Applicability

  1. These General Terms and Conditions apply to all offers, legal relationships and agreements between the parties.
  2. Upon the guest’s first request, a copy of the Terms and Conditions will be sent digitally free of charge along with the booking confirmation. In addition, the General Terms and Conditions can be consulted by the guest on the site. The latest version applies. By making a reservation at Villa V the guest accepts the applicability of these General Terms and Conditions and the House Rules. Each guest is assumed to have read both and to abide by their contents.
  3. No deviation from these terms and conditions shall be made, except in writing and in an exceptional situation. All other provisions of the General Terms and Conditions shall remain in full force in such exceptional situation.
  4. Applicability of any purchasing or other conditions of the business guest is expressly rejected.
  5. If any provision of these general terms and conditions is null and void or annulled, the other provisions of these general terms and conditions shall remain in full force and effect. In this case the parties will consult to agree new provisions to replace the void or nullified provisions, taking into account as much as possible the purpose and meaning of the original provisions.
  6. Villa V reserves the right to change these terms and conditions, tacitly or otherwise.

1. Villa V

1.1 Villa V is described on the website www.villa-v-valkenburg.nl This website has been compiled with the utmost care. However, there may be differences between the text and/or photos presented on the website and the actual situation in Villa V at the time of the visit by the guest(s). No rights can be derived by the guests from such differences.

1.2 The minimum stay at Villa V is 1 night

1.3 Villa V is accessible 24 hours a day.

1.4 Rest periods are from 10 p.m. – 7 a.m.

1.5 Smoking is not permitted in the rooms and/or common areas or anywhere indoors. However, smoking is permitted outside in the designated smoking area.

1.6 (Domestic) animals of guests are not allowed in/near Villa V.

1.7 The rooms are generally suitable for overnight stays with one and/or two persons, unless otherwise indicated in the room description on the website.

1.8 Check-in at Villa V is possible between 15.00 – 18.00 hours. If you arrive after 18.00 hours, please inform us by mail or telephone and we will provide you with an access code to the hotel.

1.9 Check-out at Villa V is possible until 10:30 at the latest. If you wish to stay longer (max. 12:30), this must be discussed in advance and costs are charged at € 25 per room.

1.10 Special requests cannot be guaranteed. If early check-in or late check-out is essential to the guest’s travel plans, we recommend checking the cancellation policy before booking.

1.11 Guests may park their cars or other motor vehicles in the designated parking lot across from Villa V. This parking lot is enclosed by a fence and can only be opened using a handheld scanner. Guests receive a hand scanner at check-in, which must be returned at check-out. Parking is at your own risk. Villa V is not responsible or liable for damage and/or theft of vehicles.

1.12 If the hand scanner is lost or otherwise not returned, €75 will be charged.

1.13 Guests must have a permanent residence or domicile.

1.14 Guests must follow the instructions of the manager.

1.15 Use of Villa V by third parties/visitors – other than the guest(s) – is not permitted.

1.16 The manager can deny and/or refuse guests access to Villa V with immediate effect in case of violation of the general terms and conditions and/or house rules or inappropriate behavior, without further notice and reasons and without refund of accommodation costs.

1.17 Guests of Villa V must abide by the internal regulations attached to the written confirmation and the welcome letter received by the guest upon arrival.

1.18 The breakfast lounge and its terrace are generally open daily until 10 p.m., but may in exceptional cases be closed (temporarily) without prior notice.

1.19 Villa V is registered with the Chamber of Commerce under number: 94479615.


2.0 Rates

2.1 Offers by Villa V are always without obligation and are subject to interim changes.

2.2 Rates include gas, water, electricity and heating. Rates are inclusive of VAT and exclusive of tourist tax.

2.3 Rates do not include cancellation and/or travel insurance and/or other costs.

2.4 In case of loss or otherwise failure to return the room key, €30 will be charged .

2.5 Rates of Villa V are always without obligation and are subject to interim changes.

2.6 All entries on the Villa V www.villa-v-valkenburg.nl website are deemed to be provided in good faith and are always subject to interim changes.

2.7. All prices are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors. In the event of printing and typographical errors, Villa V is not obliged to deliver the service and/or product at the incorrect price.

2.8. Villa V is entitled to increase prices annually in accordance with the CBS Index.

3.0 Reservation and Payment

3.1 Reservations can be made by email, telephone and online through the Villa V website www.villa-v-valkenburg.nl or can be entered into through various booking sites.

3.2 The reservation will be confirmed by Villa V in writing. In the (online) reservation confirmation reference is made to the General Conditions which are an integral part of the reservation.

3.3 The reservation is not final until a written confirmation has been received from Villa V and, if requested by Villa V, Villa V has received full payment.

3.4 No reservation fee will be charged for the reservation.

3.5 Payment for drinks, snacks and/or sweets consumed by the guest during the stay shall be made in cash or by PIN/Credit Card upon check-out. Products and/or services are not provided on account unless otherwise agreed upon.

4.0 Cancellation

4.1 Cancellations of a reservation must be communicated to Villa V in writing/email as soon as possible.

4.2 For cancellation 48 hours or less before the day of arrival or a no-show, 100% of the total cost of stay is due.

4.3 The total accommodation cost is the total amount of accommodation including VAT and excluding tourist tax due for the reserved period.

4.4 Villa V always has the right to withdraw final reservations more than 2 days prior to the date of arrival without giving reasons. Already paid advances will be refunded to the main guest without cost.

5.0 Damage

5.1 Guests must behave properly and use the Villa V accommodation in accordance with the reasonable instructions for use given by Villa V or the owner/manager.

5.2 The principal guest is legally liable for any damage caused by him or his fellow guests to Villa V accommodation or the items therein.

5.3 A case of damage (damage, loss, missing and/or theft) must be reported by the guest immediately to the owner or manager. Repair and/or replacement costs shall be immediately reimbursed by the guest to the owner/manager upon his first request.

5.4 If the room key & hand scanner are lost or otherwise not returned at check-out, Villa V will charge €30 (room key) / €75 (hand scanner).

6.0 Complaints

6.1 The guest shall always be entitled to submit a complaint to Villa V. Villa V shall always handle a complaint adequately and with due speed, so that the complaint is dealt with according to the standards of reasonableness and fairness.

6.2 The guest must report any complaint arising on arrival at the accommodation address or during the stay to the manager within 24 hours. He will then attempt to resolve the complaint.

7.0 Force Majeure

7.1 In the event of force majeure, whether permanent or temporary, Villa V shall be entitled to dissolve or temporarily suspend all or part of the contract without the Guest being entitled to claim performance and/or compensation. Force majeure shall include, but not be limited to: threat of war, war, rebellion, acts of war, strikes, boycotts, disturbances in the energy circuit, traffic or transport, government measures, scarcity of raw materials, natural disasters, and furthermore all circumstances, extraordinary weather conditions, death of one of the owners or close relatives, etc., under which full or partial performance of the contract cannot reasonably and fairly be demanded of Villa V.

7.2. If Villa V has already partially fulfilled its obligations when force majeure occurs, Villa V is entitled to separately invoice the guest for the goods already delivered. The guest is obliged to pay this invoice as if it were a separate Agreement.

8.0 Liability

8.1 Villa V cannot be held liable for damage suffered by the guest or third parties/visitors as a result of their stay in the accommodation, unless in the event of gross negligence or wilful intent on the part of Villa V. This limitation of liability shall also apply to its employees or other third parties engaged by Villa V.

8.2. Villa V is not liable for disruptions in/around the accommodation such as disruptions and failures of power and water supplies and technical installations, construction and/or road works in the vicinity of Villa V that are not announced or announced too late.

8.3. Villa V is never liable for indirect damage.

8.4. If Villa V is liable, this liability is always limited to the maximum amount that the insurer of Villa V will pay out in the event in question. If Villa V is liable and, for whatever reason, no insurance payment is made, the liability of Villa V towards the guest is limited to the amount of € 5,000.00.

8.5. Villa V accepts no liability for injury to persons and/or damage, loss or theft of property of the users.

8.6. The guest indemnifies Villa V against any damage he or she causes to others.

8.7. Villa V is not liable for any damage suffered by the guest in the event that the reservation cannot be completed, processed and/or authorized correctly or on time due to a technical failure of any kind. In such a situation, Villa V is not obliged to pay any compensation to the guest.

9.0 Privacy

9.1. Villa V processes the personal data of the guest solely in order to provide its services. Villa V processes the personal data of the guest carefully and complies with the applicable laws and regulations for the protection of personal data. The data provided by the guest is processed by Villa V in order to execute the agreement between the parties and to comply with legal obligations. Without this personal data, the guest’s booking may be delayed or made impossible and the booking may be cancelled.

9.2. The (personal) data provided by the guest will be stored for as long as necessary for the purpose described above, or as required by law and regulations. The disclaimer of Villa V applies to the processing of personal data.

9.3. The guest can submit a request for access, correction, limitation, objection, data portability, deletion of personal data or withdrawal of previously given consent. The guest will receive the contact details upon first request. If the guest has any questions or comments about the processing of personal data, the guest can contact us via info@villa-v-valkenburg.nl.

9.4. Villa V uses cameras in the public areas (entrance/front door) to prevent theft and to ensure the safety of guests. The camera images are not stored by Villa V for longer than necessary.

9.5. If the guest has any questions or comments about camera use, an email can be sent to info@villa-v-valkenburg.nl or the guest can ask his/her question at the location in Valkenburg.

10 Final provision

10.1 These general terms and conditions are exclusively governed by Dutch law.

10.2 All disputes arising from the user agreement or these terms and conditions shall be settled in the first instance by the competent court in the Netherlands, insofar as the rules of international private law do not provide otherwise.

10.3 Neither party may assign its rights and obligations to third parties to the extent not otherwise provided in these terms and conditions.

BY-LAWS VILLA V

1.0 Breakfast

Breakfast is daily between 8:30 a.m. and 9:30 a.m. and only takes place in the breakfast parlor and/or associated terrace (weather permitting).

Use Villa V
– Check-in from 3pm to 6pm. If you arrive after 6 p.m., please inform us by mail or phone and we will provide you with an access code to the hotel.

• Check-out before 10:30. If you want to stay longer (max. 12:30), this must be discussed in advance and costs are charged at € 25 per room.

– Use by third parties/visitors is not permitted

– Noise should be avoided between 10 p.m. – 7 a.m.

– Visitors/third parties may not stay overnight at Villa V without payment

– (Domestic) animals are not allowed

– Smoking is prohibited in any Villa V building. However, smoking is permitted outside in the designated smoking area.

– Radio and/or television and/or other sound sources may not cause a nuisance to other guests and/or third parties

– No refunds will be made in the event of early departure

– Lost or abandoned items will be returned to Villa V by the guest

Safety and Environment
– The presence of suspicious persons in or around Villa V should be reported to the manager/owner of Villa V as soon as possible.

– Guests can park their car or other motor vehicles in the designated parking lot across from Villa V. This parking lot is enclosed by a fence and can only be opened using a handheld scanner. Guests receive a hand scanner at check-in, which must be returned at check-out. Parking is at your own risk. Villa V is not responsible or liable for damage and/or theft of vehicles.

– Bicycles / e-bikes can be parked for free in the lockable storage room in the near future (being worked on). Villa V holds itself neither responsible nor liable for damage and/or theft.

– Garbage should be deposited in the designated trash garbage cans

– Fire protection equipment is located on each floor as well as the breakfast room

– Open fire is not allowed inside or outside

– Villa V should be kept clean and tidy and left
